U.S. Supreme Court Sends Federal Arbitration Act Interstate Commerce Exemption Issue Back to Ninth Circuit for Workers Whose Work is Entirely Inside Louisiana

 

On October 17, 2022, the Supreme Court of the United States vacated a Ninth Circuit ruling that held that delivery drivers who deliver supplies from a warehouse in California to restaurant franchise locations within the state were exempt from the Federal Arbitration Act (FAA) as a “class of workers engaged in foreign or interstate commerce.” The Supreme Court granted a petition for certiorari in Domino’s Pizza, LLC v. Carmona, but remanded the case to the Ninth Circuit with instructions to provide “further consideration in light of” the high court’s June 2022 decision in Southwest Airlines Co. v. Saxon, which held that airline employees who loaded and unloaded cargo from planes traveling interstate are exempt from the FAA.

Louisiana NEVI Workshop and Expo | Jan. 24

LCF invites you to the Louisiana NEVI Workshop and Expo. This LCF Workshop is for all potential applicants who are interested in learning about the National Electric Vehicle Infrastructure program to build out our EV Charging Corridors. Participation in this event is a great way to meet and network with potential project partners. This event is free and open for all interested stakeholders. 

 

Background: As of September 15, 2022, the Federal Highway Administration (FHWA) has approved our state's Electric Vehicle Charging Infrastructure Deployment Plan and will allocate approximately $73 million in federal funding to Louisiana over the next five years. These funds will cover 80 percent of the EV infrastructure expenses with a minimum 20 percent non-federal match covered by grant recipients.  To disburse these funds, our state is developing a competitive grant program that allows for a phased approach to the buildout of electric vehicle supply equipment (EVSE) over five years that meets federal requirements of DC Fast Chargers within one mile of designated corridors.
