2022 Winter Storm Oil & Gas Related Declarations

Updates & State Declarations

With severe winter weather affecting much of the country, we wanted to share the following state who have issued emergency declarations that may affect our members.

FEDERAL EMERGENCY DECLARATIONS BY FMCSA:

Description: WSC-MSC-SSC-ESC - Regional Emergency Declaration No. 2022-016 - Heating Fuel
Effective: 12/22/2022 | Expires on: 01/06/2023; In accordance with 49 CFR § 390.23, this Amended Emergency Declaration is effective immediately and shall remain in effect until the end of the emergency (as defined in 49 CFR § 390.5T) or until 11:59 P.M. (ET), January 6, 2023, whichever is earlier.  


Description: WSC-MSC-SSC-ESC - Regional Emergency Declaration No. 2022-016 (Heating Fuel)
Effective: 12/22/2022 | Expires on: 01/06/2023; In accordance with 49 CFR § 390.23, this Emergency Declaration is effective immediately and shall remain in effect until the end of the emergency (as defined in 49 CFR § 390.5T) or until 11:59 P.M. (ET), January 6, 2023, whichever is earlier.  FMCSA intends to continually review the status of this Emergency Declaration and the relief granted herein.  As necessary, FMCSA may take action to modify the Emergency Declaration, including modification of the transportations and commodities covered by the Emergency Declaration, extend, or terminate the Emergency Declaration if conditions warrant.


EMERGENCY DECLARATIONS BY STATE:


CALIFORNIA

Description: California Emergency Declaration 1.4.23-SOE (Severe Winter Storms)
Effective: 01/04/2023 | Expires on: 02/03/2023; These waivers shall be in effect for the duration of the driver's direct assistance in providing emergency relief, or thirty (30) days from the date of this Proclamation, whichever is less.


COLORADO:

Description: Colorado December 2022 HOS Exemption for Heating Fuel Transporters
Effective: 12/20/2022 | Expires on: 01/31/2023; The exemption shall be granted only through January 31st, 2023


IOWA:

Description: State of Iowa of Emergency (extensive challenges to timely access to supplies of motor and heating fuels)
Effective: 01/06/2023 | Expires on: 02/5/2023; This state of disaster emergency shall be effective immediately, shall continue for thirty (30) days, and shall expire on February 5, 2023, at 11 :59 p.m., unless sooner terminated or extended in writing by me. Iowa Code§29C.6(1).


GEORGIA: 

Description: Georgia Executive Order 12.21.22 (State of Emergency for Winter Weather)
Effective: 12/21/2022 | Expires on: 12/26/2022; All provisions of the Order shall become effective upon signature and shall be valid for a period of six (6) days, expiring December 26, 2022, at 11:59 P.M. unless this State of Emergency is renewed by the Governor.


KANSAS:

Description: Kansas Executive Order No. 22-09 (Conditional and Temporary Relief from Certain Motor Carrier Rules and Regulations)
Effective: 12/21/2022 | Expires on: 01/20/2023; This order will continue in effect until 11:59 PM on January 20, 2023, or until rescinded, whichever occurs first.


KENTUCKY:

Description: Kentucky Official Emergency Order 113082 (Exemption of Hours of Service Regulations for Delivery and Transport of Agricultural and Feed Products)
Effective: 12/27/2022 | Expires on: 01/20/2023; This declaration of emergency shall remain in effect until 12:01 AM EST, January 20, 2023.


LOUISIANA:

Description: Louisiana State of Emergency 194JBE2022 (Extreme Cold and Prolonged Freeze)
Effective: 12/22/2022 | Expires on: 01/20/2023; This order is effective upon signature and shall remain in effect from Thursday, December 22. 2022 to Friday, January 20. 2023, unless terminated sooner.

Description: Louisiana Proclamation Number 183 JBE 2022 - State of Emergency - Severe Storms and Tornadoes (12/13/2022)
Effective: 12/13/2022 | Expires on: 01/12/2023; This order is effective upon signature and shall remain in effect from Tuesday, December 13, 2022, to Thursday, January 12, 2022, unless terminated sooner.


NEVADA

Description: Nevada 2023-01-06_222057 (Declaration of Emergency - Proclamation Declaring a Liquid Petroleum Gas Delivery Emergency)
Effective: 01/06/2023 | Expires on: 01/21/2023; Unless renewed, this limited declaration shall expire in fifteen (15) days.


NORTH CAROLINA:

Description: North Carolina Executive Order No. 274 - SOE & Temp Suspension of Motor Vehicle Regulations
Effective: 12/20/2022 | Expires on: 01/19/2023; This Executive Order shall remain in effect for thirty (30) days or the duration of the emergency, whichever is less, unless this Executive Order is otherwise extended.


NORTH DAKOTA:

Description: North Dakota Executive Order 2022-11 (record winter storms and cold temperatures)
Effective: 12/19/2022 | Expires on: 01/18/2023; This order is effective immediately and shall remain in effect for thirty days.


SOUTH CAROLINA:

Description: South Carolina Executive Order No. 2022-40 (Transportation Waivers to Address Winter Weather Conditions)
Effective: 12/21/2022 | Expires on: 01/20/2023; This Order shall remain in effect for thirty (30) days or until the declared emergency in the State of North Carolina is terminated, whichever is less, in accordance with 49 C.F.R. § 390.23 and section 56-5-70 of the South Carolina Code of Laws, unless otherwise modified, amended, or rescinded by subsequent Order.


SOUTH DAKOTA:

Description: South Dakota Executive Order 2022-11 (Extremely low inventories and outages of propane and heating fuel.)
Effective: 12/16/2022 | Expires on: 01/15/2023; This executive order shall expire upon conclusion of the emergency, but no later than midnight, January 15, 2023.


UTAH:

Description: Utah Executive Order 2022-07 (Declaring a Liquid Petroleum Gas Emergency.)
Effective: 12/16/2022 | Expires on: 01/15/2023; This order shall remain in effect for 30 days unless the Legislature extends the state of emergency.


WEST VIRGINIA:

Description: West Virginia State of Emergency 12.22.22
Effective: 12/22/2022  | Expires on: TBD


WYOMING:

Description: Wyoming Executive Order 2022-06 (Low supplies of propane.)
Effective: 12/15/2022 | Expires on: 01/14/2023; Be it further ordered, this Executive Order is effective immediately and shall expire upon the conclusion of the emergency, but no later than midnight, January 14, 2023.

Description: Wyoming Emergency Relief Order For Propane Delivery
Effective: 12/15/2022 | Expires on: 01/14/2023; This Order will expire no later than midnight, January 14, 2023.
